Changes to waste exemption licenses in Agriculture

What we know so far: 

  • At present, there is no need for waste exemption documents and record keeping to be maintained such as evidence of quantities etc, ONLY waste transfer notes. However, this may change. 
  • Exemptions are no longer allowed on permitted sites 
  • Limits are now imposed on the number of exemptions applicable to one site – this is to avoid operation of a permitted site without the required PP and regulation 

Key changes for farmers to be aware of: 

U1 – Use of waste in construction 

  • Change in waste types and quantities 
  • Wood waste will be restricted to plant tissue only 

*There will be a 12-month transition period. 

T4 – Baling, sorting & shredding – Preparatory Treatments 

  • Reduced storage limits 
  • Waste must be kept separate and treated 
  • Stored on an impermeable surface and with sealed drainage 
  • Stacks not to exceed 4 meters in height and 250 cubic meters 

*This will be a 6-month transition period. 

S1 & S2 Changes 

  • Reduction in storage 
  • Storage of plastic limited 
  • Waste must be stored on an impermeable base 
  • Farm plastics are now limited to 1000 tonnes 

What happens next? 

*These changes are likely to be implemented from Autumn 2024, but could be postponed to Spring 2025

If you no longer comply with the new revised exemptions, please get into contact to discuss your options. It will likely be a case of ceasing activity after the transition period or applying for a bespoke permit. 

Please note that it is likely that these exemptions will attain a fee in the future (to include capital expenses). Details are yet to be confirmed and currently under consultation. 

Sanctions for Non – Compliance 

Any breach of compliance shall be handled firstly with guidance to correct the breach, however where significant breach or repetitive breach has been made, a heavy fine will be issued. Enforcement and Fixed penalty notices will be provided where applicable.
